目前,国际安保行为守则协会(ICoCA)已拥有127家会员单位,分别来自政府部门、私营安保公司、社会团体3类,其中私营安保公司102家,大部分来自欧洲国家。虽然加入的主权国政府只有6国,但是这些国家——美国、英国、瑞士、瑞典、挪威、澳大利亚——无一例外均拥有高度发达的私营安保产业,这六国也构成了有力的“内圈”,主导治理进程。
ICoCA在当前治理结构中的作用日益突出。其管理委员会由政府、企业和社会三方代表共同组成,两项主要功能分别为:第一,是在国家司法权无法有效行使或者不能履行相应义务的情况下通过协会机制直接对成员公司进行监督、问责和处罚,发挥“替代监督”作用;第二,其成员资格可以作为企业资质审查的关键指标供国家和国际组织参考,发挥“预审查”作用。行为守则协会未来所扮演的角色还可能进一步增强,其成员资格很可能成为国际私营安保市场的“通行证”。
由于国际规范只是原则指导而非具体标准,协会在标准形成过程中还将占据重要地位。根据产业发展状况,各国私营安保发展模式可以分为三类:第一类以英、美为代表,它们不仅实现了公共安全的高度外包,而且还能在高风险地区活动,甚至胜任对外政策工具;第二类则以日、德等发达国家为代表,限制私营安保涉足公共领域,同时海外开拓也并不活跃;第三类则以发展中国家为代表,中小型安保企业数量庞大,呈低水平分散状态,它们没有海外活动的意愿和能力,国家监管水平落后。中国具有明显的二重性,“发展中国家式”的产业基础与“发达国家式”的海外需求间存在严重的结构失衡。一边是规模较大的保安业,人员和资本较有规模,与国内公安部门关系密切,但缺乏海外活动的能力和意愿;另一边则是注重于保护海外利益,但是规模、资本严重不足的安保业。出于多种原因,这两者未能有效结合,导致了中国私营安保海外有效安全供给的严重不足。
